On November 1, 2023, a new Form I-9, Employment Eligibility Verification went into effect.
What Employers Need to Know About the New I-9
- Employers must make sure they’re using the new version that has an 08/01/23 edition date. The edition date is located on the bottom left of the form and instructions.
- Employers must stop using prior versions of the I-9 after October 31, 2023. Versions older than the 08/01/23 edition date will be obsolete and no longer valid or accepted to use.
- Starting November 1, 2023, employers who fail to use new version may be subject to penalties from U.S. Immigration and Customs Enforcement (ICE).
What’s Changed in the New I-9?
The new version is designed to be more digital-friendly for completion on tablets and mobile devices. It contains a number of changes intended to streamline and consolidate the form so that it’s easier for employers to complete and includes a new standalone supplement that employers can use for rehires or reverifications.
ICE is also offering new information on Acceptable Documents, including receipts, guidance and automatic extensions of employment authorization documentation. There’s a new checkbox for indicating remote verification of Form I-9 documents using E-Verify.
